NJAA Testified Before Assembly Housing Committee on the Multifamily Industry's Successes in Providing Lead-Safe and Lead-Free Housing

NJAA provided testimony before the Assembly Housing and Community Development Committee on the multifamily apartment industry's efforts to provide lead-safe and lead-free housing to New Jersey's apartment residents. NJAA's testimony focused on the pre-existing federal and state regulatory framework aimed to address lead-based paint, and the multifamily industry's efforts to either remove lead-based paint where feasible, and to safely manage it where removal is unfeasible, by following lead-safe work practices. As a result of the industry's efforts, very few cases of lead-poisoning in children is ever sourced to professionally managed rental housing.

NJAA Opposes Legislation Imposing Mandates on Businesses Utilizing State Incentive Programs

NJAA provided testimony in opposition to A-328, sponsored by Assemblyman Singleton, which would modify provisions of the Grow New Jersey Assistance (GROW) program and the Economic Redevelopment and Growth Grant (ERG) program to require, among other things, that participating businesses pay prevailing wage rates to building maintenance, custodial, and security workers.

Jersey City Council Tables 30 Hour Workweek Ordinance as Well as Another Anti-Industry Ordinance Following Strong Opposition

The Jersey City Council tabled two ordinances that would have reduced needed workplace flexibility and created significant disincentives for businesses who operate in Jersey City. Due to the strong opposition against the ordinance, the council tabled the measures.

NJAA Supports Measures that would Phase-Out New Jersey Estate Tax; Increase Tax Exclusion for Retirement Income

The Senate Budget and Appropriations Committee voted 9-0 to approve S-1728, sponsored by Senator Sarlo and Senator Oroho, which would incrementally phase-out New Jersey’s estate tax. New Jersey joins only one other state (Maryland) in imposing both inheritance and estate taxes, and New Jersey currently has the lowest exemption threshold in the country.

Governor Christie Vetoes NJAA Opposed Bill Authorizing Apartment Licensure Ordinances

On Tuesday, January 19, 2016, Governor Christie pocket vetoed S-3277, sponsored by Senator Cruz-Perez (D-Camden) and Assemblyman Burzichelli (Gloucester), which would have reversed the holding in Timber Glen v. Hamilton and allowed municipalities to license apartments. NJAA had requested a veto, and applauds the governor’s decisive action on this misguided legislation.

Federal Tax Update: Bipartisan Budget Deal Overhauls Real Estate Partnership Audits

The two year budget deal signed into law by President Obama contains provisions that overhaul the process by which large real estate partnerships are audited. Currently, the IRS holds individual partners responsible for their share of a partnership’s tax liability. Under the new measure, partnerships would be audited at the entity level. The partnership would then be responsible for any additional taxes. Additionally, there is an option for the partnership to remit amended K-1s in reporting partnership shares to the underlying partners.

DCA Adopts 2015 International Building Code and Related 2015 Model Codes

On Monday, September 21, 2015, the Department of Community Affairs (DCA) formally adopted the 2015 International Building Code (IBC) and related 2015 model codes as subcodes under the N.J. Uniform Construction Code (Chapter 23 of Title 5 of the N.J. Administrative Code). These subcodes govern the construction of new buildings and become mandatory after a six month period where a developer can build under the previous code of the newly adopted code.

Governor Christie Signs Legislation Directing State Agencies to Review Ways to Expedite Permitting

Governor Christie signed into law S-1813/A-1813, which is sponsored by Senator Jim Whelan (D-Atlantic), Senator Steve Oroho (R-Sussex), Assemblyman John Burzichelli (D-Cumberland) as well as additional Assembly sponsors and co-sponsors. The bill expands and strengthens the provisions of a 2011 law that requires each State agency to undertake a periodic review of permits issued by these agencies, in order to identify permits that are obsolete or that could be administered through an expedited procedure.

U.S. Supreme Court Rules in Long Anticipated Disparate Impact Case

On June 25, 2015, the Supreme Court of the United States in Texas Dept. of Housing and Community Affairs et al. v. Inclusive Community Project, Inc. et al, No.: 13-1371, affirmed the holding of the Fifth Circuit that the Fair Housing Act (“FHA”) prohibits decisions in housing that have a disparate impact. This means that non-profit testing groups now have an additional tool by which to measure compliance with the FHA, and argue that a policy or practice causes a disparate impact, i.e., not that your policy on its face discriminates based upon a protected category but that your policy or practice causes a discriminatory effect.

The NJAA petitioned the Appellate Division of the Superior Court to join as an amicus curiae in support of the appellant in Timber Glen vs. Township of Hamilton (Atlantic County). Key Senate Committee Approves NJAA Priority Bill to Eliminate Duplicative Municipal Registration

Legislation to eliminate duplication and redundancy in registration of apartments was approved on March 4th by the Senate Community & Urban Affairs Committee in a bi-partisan 4-0-1 vote. The bill, S-2114, builds upon a key policy recommendation released in February 2012 from the Lt Governor's bi-partisan Red Tape Review Commission calling for the elimination of redundancy in apartment registration and the double-charging of fees associated with that duplication.

New Jersey's Multi-family Housing Industry Contributes $5.7 Billion to State GDP and is Responsible for 1.2% of All Employment

A comprehensive study by the Edward J. Bloustein School of Planning and Public Policy at Rutgers, The State University of New Jersey, and commissioned by the New Jersey Apartment Association, analyzes the economic contribution of the multi-family apartment industry to the New Jersey economy and concludes that the apartment industry – comprising over 500,000 rental units in 5+ unit buildings – is a significant component of the New Jersey economy. The study estimates that in 2010, the industry directly or indirectly supported over 44,000 jobs (1.2% of the state’s total employment), contributed $5.7 billion to the State Gross Domestic Product (GDP), generated over $1 billion in local tax revenues, and $140 million in tax revenue to the State of New Jersey.

Governor Approves State Budget for FY 2012; Cuts $900 Million in Spending Approved by Democrats

Democratic majorities in both houses of the Legislature passed a $30.6 billion State budget for FY 2012 in party-line votes of 24-15 in the Senate and 46-32 in the Assembly on June 29. The next day, Governor Chris Christie used his line item veto authority to sign the bill and simultaneously cut $900M in proposed spending. The new Fiscal Year begin July 1. NJAA Presents Policy Recommendations to the Assembly Housing Committee

The Assembly Housing & Local Government Committee held a hearing on May 19 to take testimony from a group of invited guests regarding rental housing affordability issues in New Jersey. In partnership with the New Jersey Department of Community Affairs and the New Jersey Business & Industry Association, the Consortium of Community Colleges is offering a comprehensive series of training courses to meet the federal and NJ state training requirements for workers disturbing lead-based paint. Apartment firms and workers performing renovation, repair and painting projects in pre-1978 housing must be certified and follow specific work practices to prevent lead contamination. Firms must use certified renovators who are trained by EPA approved providers to follow lead-safe work practices.
