NJAA Joins Business Coalition in Support of DEP Waiver Rule Proposal

The New Jersey Apartment Association (NJAA) joined several statewide business and trade groups in supporting the NJ Department of Environmental Protection’s (DEP) recent proposal to allow a waiver of departmental rules. This proposal would bring commonsense to government by allowing the DEP to waive strict compliance with a regulation when doing so would be consistent with the department’s core mission.
Under the proposed rule the DEP will consider a waiver only after determining that at least one of four situations exists:
- When rules conflict with one another
- When strict compliance creates unduly burdensome situation
- When a waiver creates a net environmental benefit
- When a public emergency exists
The NJ Apartment Association joined with the NJ Business & Industry Association, NJ State Chamber of Commerce, NJ Chemistry Council, NJ Builders Association, NJ Food Council, and NJ Petroleum Council in submitting comments to the DEP.
